Terms of Service for Hunting Game

These Terms of Service ("Terms") govern your access to and use of Hunting Game (the "Service"), including our mobile app, real‑time multiplayer backend and APIs, companion Apple Watch functionality (where used), and our website pages.

By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1) Scope

These Terms apply to your use of the Service. They do not apply to third parties you interact with through the Service (such as app stores, platform providers, payment processors, or other users), which operate under their own terms and policies.

2) Eligibility

You must be legally permitted to use the Service where you live and where you use it.

The Service is not directed to children under 13 (or the age required by local law), and you may not use it if you are under that age. If you are under the age of majority, you may use the Service only with permission and supervision of a parent or legal guardian who is responsible for your use.

3) Accounts and Security

Some features require an account or persistent identifier. You are responsible for:

keeping your credentials and device secure;
all activity under your account;
providing accurate information when the Service requests it.

We may refuse, suspend, or terminate accounts to protect the Service, other users, or ourselves, or where required by law.

4) Location‑Based Gameplay and Safety

The Service is location‑based and movement‑oriented. If you grant location permissions, your location may be processed and shared with other players in the same active game as needed for gameplay.

You understand and agree:

Location/heading/distance data can be delayed, inaccurate, or incorrect.
The Service is for entertainment only and is not for navigation, emergency, medical, or safety‑critical purposes.
You are responsible for your safety, your surroundings, and your decisions.

DO NOT USE THE SERVICE WHILE DRIVING OR IN ANY SITUATION THAT REQUIRES YOUR FULL ATTENTION. Do not trespass, enter restricted areas, or break the law.

5) Acceptable Use

You may not:

violate law, trespass, or encourage others to do so;
harass, threaten, abuse, defame, discriminate, or otherwise harm others;
impersonate others or misrepresent affiliation;
cheat (including GPS spoofing, automation, tampering with gameplay timing/cooldowns, or bypassing entitlements);
interfere with, probe, overload, or attempt to gain unauthorized access to the Service;
collect, disclose, or misuse other players’ personal data or location outside normal gameplay.

We may enforce these rules at our discretion, including by removing content, restricting features, resetting gameplay state, suspending/terminating accounts, or taking other steps we consider appropriate.

6) User Content (including Chat)

You are responsible for content you submit or transmit through the Service (including usernames and chat messages) ("User Content"). You represent that you have the rights to your User Content and that it does not violate law or these Terms.

You grant us a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, transmit, display, and otherwise use User Content as reasonably necessary to operate, provide, maintain, secure, improve, and enforce the Service and these Terms.

We do not have to monitor User Content, but we may remove or restrict it and may suspend or terminate accounts in connection with User Content, in each case at our discretion.

7) Purchases, Subscriptions and Refunds

The Service may offer paid features (including subscriptions). Purchases are processed through app stores or other third‑party providers. Prices, taxes, billing intervals, renewal terms, and cancellation instructions are shown at the time of purchase and governed by the applicable platform rules.

Except where required by non‑waivable law, refunds are handled under the platform’s refund policies. We do not guarantee refunds.

We may change, add, or remove paid features. If a change materially affects an active subscription, we will provide any notice or remedies required by law.

8) Intellectual Property

The Service, including its software, design, branding, and content (other than User Content), is owned by us or our licensors and is protected by law.

Subject to these Terms, we grant you a limited, personal, revocable, non‑transferable license to use the Service for non‑commercial entertainment.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service except to the extent mandatory law permits despite this restriction.

Feedback you provide may be used by us without obligation or compensation.

9) Service Availability and Changes

We may add, change, rebalance, limit, suspend, or discontinue any part of the Service at any time, including features, game modes, rules, roles, and availability.

Some features are experimental or beta and may be inaccurate, unstable, or removed without notice.

10) Privacy

Our Privacy Policy explains how we collect, use, share, and retain information, including location and gameplay data. The Privacy Policy is incorporated by reference.

11) Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, to the extent permitted by law, including for suspected violations of these Terms, fraud, cheating, security issues, or legal compliance.

Upon termination, your right to use the Service ends. We may delete or de‑identify information as described in our Privacy Policy and as required/permitted by law.

12) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR‑FREE, OR THAT LOCATION/HEADING/DISTANCE INFORMATION WILL BE ACCURATE.

Some jurisdictions do not allow certain disclaimers; in those jurisdictions, disclaimers apply to the maximum extent permitted.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12‑MONTH PERIOD WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE DURING THAT PERIOD.

Some jurisdictions do not allow certain limitations; in those jurisdictions, limitations apply to the maximum extent permitted.

14) Indemnity

To the maximum extent permitted by law, you will defend, indemnify, and hold us harmless from claims arising out of your use of the Service, your User Content, or your violation of these Terms or law.

15) Changes to these Terms

We may update these Terms from time to time. The "Last Updated" date above indicates when these Terms were last revised. Your continued use of the Service after an update means you accept the updated Terms to the extent permitted by law.
